The purchases of goods and services from BULL AND BEAR KIOSK are subject to the Terms and Conditions of Sale stated below.

We exclusively offer brand new products that are 100% authentic. The warranty is provided directly by the manufacturer and is included with the purchased item.

Definitions

1.1. In these terms and conditions, the following definitions apply:

Business Day(s): Refers to any day, except Saturdays, Sundays, or public holidays, on which banks are open for business. Conditions: Refers to the terms and conditions stated in this document, which may be amended periodically in accordance with clause 14. Contract: Refers to the agreement between BULL AND BEAR KIOSK and the Customer for the purchase and sale of Goods or Services, in accordance with these Conditions. Customer, you, your: Refers to the individual who purchases Goods or Services from us. Event Outside Our Control: Has the meaning specified in clause 13. Goods: Refers to the items listed in the Order, either in whole or in part. BULL AND BEAR KIOSK, we, us, our: Refers to lx-sports.com, Lx-Sports, or “BULL AND BEAR KIOSK”, a registered company in Germany, VAT DE 06436003, located at Mergenthalerallee 77, 65760 Eschborn, Germany. Order: Refers to the Customer’s request for Goods or Services placed through the Website. Services: Refers to the services listed in the Order, either in whole or in part. Website: Refers to lx-sports.com.

1.2. In these Conditions, the following rules are applicable:

1.2.1. The term “person” includes natural persons, corporate entities, or unincorporated bodies, regardless of their legal personality. 1.2.2. A reference to a party includes their personal representatives, successors, or authorized assigns. 1.2.3. Any phrase introduced by the terms “including,” “include,” “in particular,” or any similar expression is illustrative and does not limit the meaning of the preceding words. 1.2.4. References to writing or written communication include emails.

The Contract

2.1. Placing an Order through the Website constitutes an offer to purchase Goods or Services in accordance with these Conditions. It is important to carefully review and verify your Order before placing it, as you are responsible for ensuring its accuracy. You may only purchase Goods or Services from us if you meet the legal age requirement applicable to such purchases.

2.2. Any email, order confirmation, or other electronic acknowledgment of receipt from us does not imply our legal acceptance of your Order. The Order will be considered accepted by us, and a Contract will be formed when:

(a) You have made payment for the Goods or Services, and we have received the funds; and

(b) If applicable, the Goods have been dispatched, and we have sent you a dispatch confirmation; or

(c) If applicable, the Service(s) have been carried out.

2.3. All Orders placed through the Website are subject to availability of stock, in-store or garage, and are also subject to the validation checks described in clause 5 below. In the unlikely event that you are able to place an Order for an item that is not available in stock, or if it becomes necessary for BULL AND BEAR KIOSK to modify or cancel a booking for Services, we will contact you promptly to discuss the possibility of amending or canceling your Order. If BULL AND BEAR KIOSK cancels your Order, a full refund will be issued.

2.4. We accept Orders from worldwide customers.

2.5. Garage services are only applicable to the specific vehicle booked at the time of the Order and cannot be transferred to another vehicle. Please note that, in order to provide efficient service and manage high demand, we may occasionally utilize DVSA approved test stations carefully selected by BULL AND BEAR KIOSK to perform certain Services. This does not affect your statutory rights, and your Contract remains with BULL AND BEAR KIOSK.

2.6. We will retain the details of your Order in our database, and upon request, our customer services team can provide you with access to these details.

Product Information

3.1. The Goods and Services are described on the Website. We reserve the right to modify the description if necessary.

3.2. The images of the Goods displayed on the Website are for illustrative purposes only. The online representation of colors is as accurate as our photographic and electronic processes allow. Please note that color perception may vary depending on individual device calibrations.

3.3. All weights and sizes provided are approximate and intended as a guide only.

3.4. Guided Sales, Buyers Guides, and other advisory articles are created by BULL AND BEAR KIOSK to assist you in making informed purchasing decisions. These articles are for general information purposes, and if you have any doubts, it is advisable to seek guidance from a relevant professional. We are not liable for any loss, damage, or injury arising from the advice provided on our Website.

3.5. In the event of any errors in the price or description of Goods or Services, we reserve the right to rectify the error and inform you accordingly. In such cases, it will be considered that a contract has not been established, and you are not obligated to proceed with the purchase. We will cancel your Order, and you will receive a full refund. The reimbursement of any payments made to us will be the extent of our liability to you in the event of such errors.

Price Information

4.1. Unless otherwise stated below, the price of the Goods and Services is the price displayed on the Website at the time you place your Order. All prices are indicated in EURO.

4.2. The price of the Goods does not include delivery charges, which will be provided during the check-out process before you confirm your Order.

4.3. For certain Services, additional costs may apply if extra work is carried out on a vehicle, and these costs must be paid when collecting the vehicle. We will never perform any additional work on a vehicle without obtaining your prior consent.

4.4. The price of the Goods and Services includes VAT, where applicable. If the VAT rate changes between the Order date and the delivery date, we will adjust the VAT accordingly, unless you have already paid for the Goods or Services in full prior to the VAT change.

4.5. The prices shown are applicable only to purchases made through the Website. Occasionally, the prices and promotions available online may differ from those offered simultaneously at physical BULL AND BEAR KIOSK stores. Some Service prices may vary depending on the geographical location.

4.6. If the online price is lower than the price in our physical store, you may be eligible to make a Price Match claim.

4.7. Special offers and promotions advertised in the press or other media may not be available on the Website unless specifically stated as online offers. All offers are subject to availability and while stocks last. This includes offers promoted through official Halfords social media channels.

4.8. Offers cannot be combined with each other. If multiple offers are available for the same product, only one discount will be applied. The offer providing the greatest savings will be applied in the shopping basket. Similarly, voucher code offers cannot be used in conjunction with any other promotional offer. Proof of membership for discount eligibility may be requested.

Payment Information

5.1. BULL AND BEAR KIOSK accepts payment through most major credit or debit cards and bank transfers. We do not accept any other forms of payment online. For more details about accepted payment methods, please refer to our Payments section.

Delivery of Goods

6.1. Any delivery dates provided are approximate, and we cannot be held responsible for any costs incurred due to delivery delays. Third-party couriers such as FedEx or DHL may deliver direct delivery orders between 7am and 9pm.

6.2. Delivery of an Order is considered complete once we have delivered the Goods to the specified delivery address provided in the Order.

6.3. The responsibility for the Goods transfers to you upon delivery.

6.4. In cases where the courier is unable to deliver the Goods, they may attempt to deliver to a neighboring address, schedule a redelivery for the following day, leave a card for you to arrange a suitable redelivery time, or leave the parcel at their local office for you to collect.

6.5. We are not liable for any delay in the delivery of the Goods or failure to deliver the Goods if such delay or failure is caused by an Event Outside Our Control or your failure to provide adequate delivery instructions or any other relevant instructions related to the supply of the Goods.

6.7. If we exceed our estimated delivery deadline for the Goods, or if we have not delivered the Goods within 30 days after sending the dispatch confirmation, you have the right to cancel your Order and receive a full refund. You can cancel the entire Order or only specific items, unless BULL AND BEAR KIOSK informs you that splitting the Order would significantly reduce its value.

Cancellations, Refunds, and Returns

7.1. If you change your mind about a purchased and delivered item, you have the right to return it within 90 days from receipt of the Goods and receive a refund or request an exchange. Please refer to our Returns & Exchange page for our returns policy.

7.2. The right to cancel does not apply to personalized and made-to-order products or Goods that become inseparably mixed with other items after delivery, unless they are faulty.

7.3. The deadline for canceling a Contract depends on the type of order and delivery. Please refer to the table below for specific cancellation periods:

7.4. To cancel or amend a Contract, please contact our Customer Services Team via phone, email, letter, or the online form on our Website. Provide details of your Order to assist us in identifying it. Cancellation is effective from the date of sending the notice.

7.5. If you cancel the Contract, we will refund the price paid for the Goods, including any delivery costs, within specified deadlines. We may reduce the refund if the value of the Goods has been diminished due to handling beyond what is necessary. Refunds will be made to the original payment method.

7.6. If the Goods are returned due to being faulty or misdescribed, we will provide a full refund, including applicable delivery charges.

7.7. Goods should be returned without undue delay, within 14 days of notifying us of the cancellation. You are responsible for the cost of return unless the Goods are faulty or not as described. Take reasonable care to ensure the Goods are not damaged during transit.

7.10. Your legal rights for faulty or misdescribed Goods are separate from the right of return. For more information, consult your local Citizens’ Advice Bureau or Trading Standards office.

7.11. In some cases, cancellation before delivery may not be possible. If the Goods are delivered, you can still exercise your right to return them as outlined above.

After-sales Service and Guarantees

8.1. The Goods or Services may come with manufacturers’ guarantees or service arrangements, which will be provided where applicable. In most cases (99%), the manufacturer offers after-sales service and warranty/guarantee.
8.2. Unless explicitly stated otherwise, warranties are non-transferable and apply only to the original Customer. If you purchase Goods with a BULL AND BEAR KIOSK warranty, we guarantee that those Goods will function during the warranty period. If you replace the Goods within the warranty period, the warranty does not reset. You will only have the remaining duration of the original warranty. This does not affect your statutory rights in case the Goods are faulty or not as described.

Complaints and Inquiries

9.1. If you are dissatisfied with any aspect of our online service, encounter a problem with our website, or have any questions or comments regarding an order placed online, please get in touch with us. We will make every effort to assist you.

9.2. If we have exhausted our internal procedure for handling complaints and we inform you in writing that we are unable to resolve your complaint, you have the option to refer your complaint to an Alternative Dispute Resolution (ADR) provider for resolution. We are not obligated to use a specific ADR provider or procedure, but you can find a list of certified providers at https://www.tradingstandards.uk/commercial-services/adr-approved-bodies. Alternatively, you can refer your complaint to the Online Dispute Resolution (ODR) Platform of the EU Commission at www.odreurope.com. Please note that our participation in ADR is not mandatory.

9.3. Occasionally, your access to Lx-Sports.com may be temporarily limited to allow for the introduction of new products or features, site development, maintenance, or repairs. We will make reasonable efforts to restore the service as soon as possible.

9.4. If you have been directed to the website from a third-party site, please be aware that those sites are independent of us, and we are not responsible for them. Refer to the terms and conditions of the respective site for further information.

10.1. We have taken all necessary precautions to ensure that shopping on the internet with BULL AND BEAR KIOSK is as secure as making a card purchase in a physical store. Our secure server software encrypts all personal information transmitted over the internet. During order processing, your information may be transmitted over the internet more than once, but it is always encrypted.

10.2. While BULL AND BEAR KIOSK strives to protect your personal information by taking reasonable measures, we cannot guarantee the complete security of any data you disclose online. You acknowledge the inherent security risks associated with providing personal information and conducting online transactions over the internet, and BULL AND BEAR KIOSK cannot be held responsible for any security breaches unless they result from our negligence. Liability

12.1 If we fail to comply with these conditions, we are liable for any foreseeable loss or damage that you may suffer as a direct result of our breach of these conditions or our negligence. However, we are not responsible for any loss or damage that is not reasonably foreseeable. Loss or damage is considered foreseeable if it is an obvious consequence of our breach or if it was contemplated by both parties at the time of entering into this contract.

12.2 Unless expressly stated otherwise and agreed upon in writing with you, we provide goods or services solely for domestic and private use. You agree not to use the goods for any commercial, business, or resale purposes, and we hold no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

12.3 We do not exclude or limit our liability in any way for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of the terms implied by sections 9 to 11 or 17 of the Consumer Rights Act 2015; and (d) defective products under the Consumer Protection Act 1987.

Events Outside Our Control

13.1 We will not be held liable or responsible for any failure or delay in performing our obligations under a contract if it is caused by an Event Outside Our Control. An Event Outside Our Control refers to any act or event beyond our reasonable control, including but not limited to strikes, lock-outs, or other industrial actions by third parties, civil commotion, riots, invasions, terrorist attacks or threats of terrorist attacks, war (whether declared or not) or threats or preparations for war, fire, explosions, storms, floods, earthquakes, subsidence, epidemics, or other natural disasters, as well as the failure of public or private telecommunications networks or the impossibility of using railways, shipping, aircraft, motor transport, or other means of public or private transport.

Variation

14.1 BULL AND BEAR KIOSK may modify these Conditions periodically. Each time you place an order for Goods or Services, the Conditions that are in effect at the time of your order will apply to the Contract between you and us.

Communications between us

15.1. Any notice or communication provided to you in relation to the Contract will be in writing (including email) and addressed to the address you have specified to us in writing as per this clause. It may be delivered in person, sent by prepaid first-class post, recorded delivery, commercial courier, fax, or email.

15.2. A notice or communication will be considered received: if delivered in person, upon being left at the address mentioned in clause 15.1; if sent by prepaid first-class post or recorded delivery, at 9:00 am on the second business day after posting; if delivered by commercial courier, on the date and time when the courier’s delivery receipt is signed; or if sent by fax or email, one business day after transmission.

15.3. The provisions of this clause do not apply to serving any legal proceedings or documents in connection with any legal action.

Other Important Terms

16.1 We have the right to transfer our rights and obligations under a Contract to another organization. However, this transfer will not affect your rights or our obligations under these Conditions.

16.2 You may only transfer your rights or obligations under these Conditions to another person if we provide written agreement.

16.3 This Contract is solely between you and us. No other person has the right to enforce any of its terms.

16.4 Each paragraph of these Conditions operates independently. If any court or relevant authority determines any of them to be unlawful or unenforceable, the remaining paragraphs will remain valid and in effect.

16.5 If we fail to insist that you fulfill any of your obligations under these Conditions, or if we do not enforce our rights against you, or if we delay in doing so, it does not mean that we have waived our rights against you or that you do not need to comply with those obligations. If we do waive a default by you, we will only do so in writing, and it will not automatically mean that we waive any future defaults by you.

16.6 These Terms are governed by German laws. This means that any Contract for the purchase of Goods through our Website and any disputes or claims arising from or in connection with it will be subject to German and EU laws. Both you and we agree that the courts of Germany and the EU will have non-exclusive jurisdiction. The Contract can only be concluded in English.
